Fitch allegedly shot and killed Patrick July 30 during a traffic stop in West St. Paul. Fitch was captured in St. Paul's North End after an eight-hour manhunt ended in a gun battle that wounded him near Rice and Sycamore streets.
Friday's indictment came from a grand jury that included people from Dakota and Ramsey counties.

Fitch is still receiving treatment for multiple gunshot wounds at a clinic in the Minnesota Correctional Facility in Oak Park Heights, Backstrom added.
