The defense lawyer for a Minnesota man imprisoned for a fatal crash involving a Toyota says his original attorney made serious mistakes in his original trial.
Attorney Brent Schafer is seeking a new trial for Koua Fong Lee, the driver in a 2006 Camry accident in St. Paul that killed three people.
In papers filed this week, Schafer says Lee might not have been convicted if not for the mistakes. He says Lee's first lawyer agreed with prosecutors during his 2007 trial that Lee must have stepped on the gas instead of the brake. That's contrary to what Lee testified.
He says the lawyer also failed to call an inspector to the stand who could have testified he found evidence Lee was braking when his Camry smashed into an Oldsmobile.
