La ley “Licencia de Conducir para Todos,” que entró en vigencia el 1 de octubre del año pasado, eliminó la necesidad de tener que demostrar estatus legal en los Estados Unidos para poder obtener una licencia de conducir o una tarjeta de identificación estándar en Minnesota.

Como consecuencia, alrededor de 81.000 residentes que carecían de estatus legal permanente pasaron a ser elegibles para obtener una licencia de conducir. No obstante, también tuvieron presentar una prueba de identidad y aprobar el examen escrito de conocimiento y el de manejo.

Según datos proporcionados por el Departamento de Seguridad Pública (DPS por sus siglas en inglés), en los primeros seis meses desde que la ley entró en vigencia, el número de pruebas escritas de manejo aumentó un 44 por ciento respecto al mismo período de seis meses del año anterior,

Hasta la fecha, el mayor aumento (más de 10 veces) se produjo en las pruebas de español, de 7.008 de octubre de 2022 a marzo de 2023, a 72.417 de octubre de 2023 a marzo de 2024. También hubieron aumentos menores en los exámenes en vietnamita, somalí y hmong. Puede que las cifras también consideren a personas que toman la prueba más de una vez.

La ley de Licencia de Conducir para Todos fue respaldada por fuerzas del orden, grupos religiosos y empresariales y defensores de los derechos de los inmigrantes. Ellos sostienen que la ley mejorará la seguridad pública al garantizar que todos los conductores tengan licencia y seguro.

“Lo bueno de ver un aumento en las cifras es ver cuántas personas realmente quieren tener licencia y poder conducir legalmente; la gente lo ve como algo importante que deben hacer ahora que pueden hacerlo", dijo Julia Decker, directora de políticas del Centro de Derecho de Inmigrantes de Minnesota.

Jody-Kay Peterson, directora del programa de servicios para conductores y vehículos del DPS dijo que si bien no se puede asegurar que el aumento en las pruebas de manejo se atribuye a la nueva ley, los funcionarios estatales suponen que es un factor importante.

Según Peterson, el aumento de exámenes tomados fue más de lo esperado. Los funcionarios estatales habían estimado que alrededor del 20 por ciento de los individuos elegibles mayores de 16 años presentarían su solicitud en el primer año, pero resultó ser mucho más que eso.

“Estamos haciendo lo mejor que podemos para actualizarnos y, en efecto, estamos aprendiendo mucho a medida que avanzamos en este proceso”, dijo Peterson. “Por supuesto que siempre hay espacio para mejoras”.

Peterson agregó que DPS recibió fondos para contratar 12 nuevos examinadores y personal adicional encargado de revisar las solicitudes. La directora afirma que tales fondos sirven para abordar el desafío estatal actual de encontrar citas disponibles para las pruebas de manejo.

Datos de los primeros seis meses desde la adopción de la ley muestran que muchos solicitantes han tenido dificultades para aprobar el examen. Casi tres cuartas partes de los que tomaron la prueba escrita de conocimiento en español, entre octubre y marzo, reprobaron. Este número es más alto que la tasa media de fracaso a nivel estatal del 59 por ciento.

Peterson señala que eso podría deberse a una combinación de factores. Hay quienes pueden tener dificultades para traducir la versión latinoamericana del español en el examen. Otros tal vez necesiten más tiempo para prepararse.

“Definitivamente, estudiar y estar preparado para el examen podría mejorar la tasa de aprobación”, dijo Peterson. “Vemos que algunas personas llegan a nosotros sin estar realmente preparadas, en especial para el examen práctico, y se nota que no han practicado lo suficiente”.

El DPS está lanzando nuevos videos y otros materiales para ayudar a los postulantes a prepararse. Los grupos comunitarios también han organizado sesiones de estudio o talleres para revisar el manual.

La directora de políticas del Centro de Derecho de Inmigrantes de Minnesota Julia Deker dijo que en líneas generales la implementación de la ley se ha desarrollado relativamente sin problemas. Según Deker, como ocurre con cualquier cambio importante de ley, se viene generando una curva de aprendizaje a medida que los funcionarios del gobierno y los residentes descubren el nuevo proceso.

“A nadie realmente le gusta ir al DMV por asuntos relacionados a la licencia de conducir”, dijo Decker. La directora agregó que es necesario explicar a los miembros de la comunidad que “Sí, hay largos tiempos de espera. Sí, se requieren documentos adicionales y no, no será tan simple”.

La ley amplió la lista de documentos que un residente puede proporcionar para demostrar que vive en Minnesota, esta incluye pasaporte extranjero, certificado de nacimiento extranjero o certificado de adopción.

Claudia Lainez de la organización sin fines de lucro COPAL (Comunidades Organizando el Poder y Acción Latina) dijo que hay mucha confusión en la información distribuida desde que se aprobó la ley.

Lainez comentó que hay casos de personas a quienes se les solicitó presentar prueba de residencia legal en los Estados Unidos a la hora de acudir a las oficinas de licencias de conducir. También dijo que muchos tuvieron problemas para encontrar vacantes para los exámenes e incluso tuvieron que conducir largas distancias para conseguir una cita.

“Supongo que la situación está mejorando”, dijo Lainez. “Es un proceso nuevo, así que era de esperarse. Y creo que todo el mundo se está adaptando”.

Julia Deker dijo que es demasiado pronto para saber si la ley está logrando su objetivo de mejorar la seguridad pública, al menos en términos de estadísticas de accidentes o seguros.

“El peligro de esas estadísticas es mirar las cifras y decir: ‘Obviamente esto tuvo que ver con la nueva ley que entró en vigor’, versus otras cuestiones que también podrían haber causado una diferencia en los resultados”, dijo Decker. “Pero sí creo que será interesante, tal vez al cabo de uno, cinco o diez años, ver qué tipo de efecto ha habido, si es que ha habido alguno”.

En los Estados Unidos, otros dieciocho estados y el Distrito de Columbia otorgan licencias a residentes independientemente de su estatus migratorio.
